TAUNTON - An off-duty Attleboro firefighter admitted Friday to assaulting a Taunton police officer answering a call three months ago about a domestic dispute involving the firefighter.

James F. McCracken Jr., 37, an 8-year-veteran firefighter, was placed on probation in Taunton District Court, where his case was continued without a finding for one year. He paid a $50 court fee, according to court records.

In addition to assault and battery on a police officer, McCracken also admitted to being disorderly and resisting arrest. A charge of assault and battery by means of a dangerous weapon: shod foot, was dismissed at the request of the prosecution.

McCracken allegedly fought with Taunton Patrolman Peter MacDougall in early December when MacDougall responded to a domestic call at the B & E Convenience Store on Weir Street.

The confrontation escalated into a wrestling match, with McCracken allegedly trying to choke and punch MacDougall as they rolled around on the gas station's asphalt, according to a police report. MacDougall, who was not seriously injured, had to be assisted by another officer in subduing McCracken, according to a police report.

The incident started soon after an unidentified witness called police alleging that McCracken, who police say had been drinking, hit his wife, although no charges were filed on the allegation.

The prosecution and defense agreed on the disposition of the case, which was accepted by Judge James McCallum, according to court records.

McCracken, accompanied at the court by his wife, Shirley, declined comment.

His lawyer, Bruce Thompson of Attleboro, said the disposition of the case was no different that any other first-time offender of the same age with no criminal record.

If McCracken has no other brushes with the law during his probationary period, the case will be dismissed.

Attleboro Mayor Kevin Dumas placed McCracken on paid administrative leave, pending an independent investigation by the city. The mayor could not be reached Friday for comment on McCracken's employment status.

Fire Chief Ronald Churchill referred a call for comment to the mayor.

McCracken resides in Swansea with his wife and two children.
