NORTH ATTLEBORO - A 23-year-old man has pleaded guilty to breaking into his grandmother's house and assaulting her in 2005 in a case in which the 72-year-old woman was bound with duct tape for 20 hours before she was able to summon help.

Jonathan D. Butler was sentenced in Taunton Superior Court Monday to serve two years in prison, but was given credit for the two years he already served for violating his probation, authorities said.

The victim, Delores Butler, moved to Arizona to live with a daughter after the Aug. 19, 2005, incident at her Cumberland Avenue home. She died in Arizona in February 2007 of unrelated causes while the case was still pending.

Delores Butler told police two assailants entered her home, and she thought one of them was her grandson, Jonathan. She later testified at a probable cause hearing that she was unsure whether her grandson was involved.

During her testimony, Butler said the lights in her home were turned off before she was struck on the forehead twice with a telephone. One of the men bound her with duct tape and rings were pulled off her fingers, she said. Both of the men wore something covering the lower half of their faces, she testified. She said she managed to crawl to the kitchen to call 911 from another phone.

She suffered a broken nose and jaw and bruises about her face and body in the assault. She was hospitalized at Rhode Island Hospital in Providence for eight days.

Jonathan Butler, who now lives in Arizona, pleaded guilty to burglary and assault charges.

"This was a good disposition, with all things considered," said Gregg Miliote, spokesman for Bristol County District Attorney Sam Sutter.
