ATTLEBORO - A 74-year-old blind woman has been told a lien will be put on her South Attleboro home if she doesn't come up with a penny she owes on an outstanding utility bill.Eileen Wilbur, of Glenn Street, said she discovered the notice of the potential lien after her daughter, Rose Brederson, came over to read her mail. "It's so upsetting," Wilbur said. "It sent my blood pressure up so high." The city sent Wilbur a letter dated Nov. 10 stating that if the 1 cent balance is not paid by Dec. 10, the city will assess a lien of up to $48 on Wilbur's next property tax bill. City Collector Debora Marcoccio said the bill was sent out along with more than 2,000 others as the city tries to recoup outstanding balances before resorting to putting liens on property.A computer automatically printed the letters for any account with a balance remaining, and they were not reviewed by staff before being sent out, Marcoccio said. "It would be fiscally irresponsible for me to have staff weed through the bills and pull out any below a certain amount," Marcoccio said. " And what would that amount be?" According to the letter, the outstanding balance stems from a water and sewer bill from fiscal year 2008, which ran from July 2007 to July 2008. Marcoccio said that before lien notices are sent out, the city sends out bills for the outstanding balance. "My question is, how come it wasn't paid when the bills went out?" she said. In the meantime, the city is holding firm on the amount due. Marcoccio, who called the whole situation "ridiculous," said the city will not waive the balance. "If there's a bill, it must be paid," she said. Brederson said her mother was very upset by the situation, but will likely end up paying the penny to avoid having the cost rise. Where do you draw the line on how much the water utility can ignore, one cent, two cents maybe 3 cents? When you add up a few thousands people who might owe a penny or two it does add up. As chintzy as it may sound the water utility is correct, however, to threaten to put a lien on her house is going to far.
Spending 42 cents on a stamp in order to collect 1 cent is outrageous. What they ought to do is add the 1 penny on to her next bill, with a statement of explanation. This could save thousands of tax payers dollars. "

All of you should know the facts behind the entire process - oh that's right the SC doesn't want you to know that. Kirby sends out a rookie to cover a "non-story" and it turns out that he ends up using it as front page fodder. What he didn't do is have his intrepid reporter research the facts of the case. What date was the bill actually from? How many previous notices were sent? What is the procedure for placing utility bills on someones tax bill? Is $48 a flat fee or is that the highest amount that can be charged? What did previous Collectors do in this case?

Example: in 1990, when I returned from Florida, there was a hold on my driver's license renewal because of an offense someone else with the same name committed in FLA. I had to go through three offices in the Boston DMV before the issue was resolved and I was finally allowed to renew my license. It was an all-day nightmare.
Guess what? It was never resolved. In 2002 and 2007, NH DMV twice held up my license renewal. Why? Because there was an outstanding issue from MA going back to 1990 regarding a FL driver with the same name as mine. Go figure, huh?
18 years that mistake has been in the system, and I can't get it out, even though they told me it was a done deal.
And that's just scratching the surface.
If this woman is smart, she'll pay her penny and get the hell out of the system before it crushes her.
There's a lot I like about MA, but the governments REALLY suck! They'll squeeze a blind woman for a penny, but have absolutely no problem shelling out welfare and Medicaid to 30,000-plus illegals.

Interest at the rate of twelve (12%) percent per annum from the date of the bill to the date of payment shall be collected for sewer use charges not paid within thirty (30) days of the date of the bill and thus deemed to be delinquent. any delinquent sewer use charge, together with the interest due, shall constitute a lien upon the real estate for which such service is supplied. This ordinance to be effective May 5, 2005, with the Council giving permission to the Collector to enclosed a separate notice highlighting the change. "

Print letters for balances > $1 or whatever arbitrary amount makes sense. I'm no computer wizard but I believe computers are capable of such tasks. I would also think that a priority should be put on unpaid/ignored bills and move to the threat of a lien if two bills in a row are unpaid.
This is a profitable move by the city. $48 would more then cover the postage and administration fees associated with the collection of a penny. "
