AG's office OKs NA zoning changes

NORTH ATTLEBORO - The wait is over: The state attorney general's office has approved three zoning bylaw changes made at October's town meeting that lay out the rules and regulations for constructing adult retirement communities in town.
The attorney general's office had postponed its review of the bylaw amendments because a public hearing on the amendments was held one day earlier than is allowed by law.
State statute requires the planning board to hold a public hearing, posted two weeks ahead of time, on any zoning bylaw amendments.
The planning board missed the time frame by just one day as the meeting was announced Sept. 12 and the hearing was held 13 days later, rather than the 14 days required.
To rectify the situation, the town was required to alert the community that approval had been postponed through postings and newspaper advertisements. Residents then had 21 days to file a letter with the town clerk's office indicating the early public hearing was misleading or otherwise prejudicial.
No one filed a letter with the town clerk's office and as a result, the zoning bylaw changes were approved by the attorney general's office.
