Teen in fatal crash held in OUI

Norfolk woman arrested in Ashland
NORFOLK - A Norfolk teenager on probation for a December 2006 fatal hit-and-run accident in Wrentham was ordered into substance abuse treatment Tuesday after a weekend drunk driving arrest in Ashland.
Ashland police allege Elizabeth Finnegan, 19, of 30 Rockwood Drive, was drunk behind the wheel and her car stuck in a snowbank early Sunday morning in Ashland.
She and a friend were slumped against the center console of a car off the road at Oak Street and Whipporwill Lane about 7:40 a.m., Ashland Police Lt. Richard Briggs said.
Police charged Finnegan with driving under the influence of alcohol, being a minor in possession of alcohol, resisting arrest and negligent operation.
The arrest violated Finnegan's probation for the Dec. 21, 2006, hit-and-run accident in which a pedestrian, Jeffrey W. Cardin, 48, of Shears Street in Wrentham, was killed, said Coria Holland, a spokeswoman for the state probation commissioner's office.
Cardin, a father of three from Millis, was walking home from the Anvil Pub in an area with no sidewalks when he was struck about 100 yards from a rooming house where he was staying on Walnut Street in Wrentham.
Finnegan turned herself in to Wrentham police the next day, and told investigators she was driving in that area during the night of the accident and thought she might have hit something.
In the most recent case, Finnegan was ordered into substance abuse treatment and was told to stay away from drugs and alcohol following a detention hearing Tuesday in Wrentham District Court, Holland said.
A probation violation hearing is scheduled for April 3.
Finnegan's attorney, Vanessa Sanchez-Gasparro of Natick, declined to comment.
Finnegan has refused to cooperate with Ashland police since Sunday's incident, Briggs said.
Finnegan "refused to answer any questions" and invoked her right to remain silent at the MetroWest Medical Center in Framingham, where she and passenger Carrie O'Shea, 20, of 158 North St. in Norfolk, were taken by Ashland paramedics for treatment of minor injuries, Briggs said.
Finnegan and O'Shea refused treatment, he said.
The incident began when Ashland police responded to a report of a car off the road with two unconscious women inside, Briggs said.
Investigating officers found Finnegan and O'Shea slumped over the center console of the car, and Finnegan "became combative" as officers and paramedics tried to remove her from the car, Briggs said.
Finnegan had to be restrained on an ambulance stretcher until she calmed down, he said.
She was "incoherent, unable to answer basic questions from the officers, such as her name or date of birth," Briggs said.
Police say they searched the car and found two beer cans, a pint-size bottle of 80-proof E & J brandy about two-thirds empty on the passenger side floorboard, and a tan purse. They also found a small bag holding less than an ounce of alleged marijuana in O'Shea's purse.
The car's transmission was in drive, and the ignition was switched on, Briggs said.
The front passenger side tire was missing and the aluminum rim was flat, indicating the car had "driven on a flat tire for a distance," he said.
At the hospital, Finnegan told police "she couldn't be arrested unless her lawyer was present," Briggs said.
At some point, Finnegan asked to smoke a cigarette.
When she was denied, she "lunged at an officer in an effort to get out of the room," Briggs said.
She was restrained, charged with resisting arrest, then was booked at the Ashland police station.
Finnegan was released without bail following her arraignment Monday in Framingham District Court, a court official said. Her next court date is April 22.
O'Shea, meanwhile, will be summonsed to court to face a charge of minor in possession of alcohol.
Police also cited her for possession of less than an ounce of marijuana, a civil infraction.
