Assault case against NA man dismissed

Victim is no-show in city court
ATTLEBORO - The case against a North Attleboro man charged with assaulting another man at a South Main Street apartment in February 2008 was dismissed Wednesday after the victim did not appear in court.

Eric Burrill, 34, of 44 Elm St. in North Attleboro, and another man had been accused of breaking into an apartment at 240 South Main on Feb. 6, 2008. All the men knew each other and alcohol was a factor in the incident, according to arguments in Attleboro District Court.

Burrill had picked up a bat after the victim punched and knocked out his friend.

Police accused him of threatening the victim, but his lawyer, Daniel Rich of Norton, argued that his client acted in self-defense after seeing his friend knocked out.
