FOXBORO - Health board members say they are out of patience with a local convenience store's repeated failure to remove all out-of-date food items from its shelves.

The board of health fined XPress Minimart at 126 Main St. $100 this week for offering to sell dozens of outdated packaged food items, and threatened to revoke the store's food license if the problem is not corrected for good.

The store is separately licensed to sell beer and wine.

Board members told owner Malini Patel the latest violation was at least the fourth time health inspectors have cited the store for displaying expired foods on its shelves.

"I'm not sure a fine is going to matter. You told me last year that you'd never be in here again," Chairman Paul Steeves told Patel. Patel blamed the problem on her wholesaler, claiming that the vendor delivered the out-of-date products. She faulted one of her employees for failing to notice the dates on the products.

The May 27 inspection report by Town Sanitarian Marc MacFarland lists more than 40 out-of-date items. Several items expired last year. The expiration date was covered by price tags on some items.

MacFarland's March 3, 2008, inspection found 64 out-of-date items, many of them dairy. At the time, Patel agreed to correct the problems and put in a plan to prevent further violations.
