Police charge pair in crash for I-495 death




NORTON - State police have charged two drivers in a fatal accident on Interstate 495 last March, including one driver charged with manslaughter by motor vehicle and motor vehicle homicide while driving drunk.

One person was killed and five others were injured in the high-speed crash.

Juliano DaSilva, 28, of Avon, was the driver of a Nissan Maxima, who was allegedly speeding in the southbound lanes of I-495 before he lost control of the car, rolled over and struck several trees around 3 a.m. on March 22.

One of two passengers in his car, Eduardo M. Dias, 25, of Hyde Park, was pronounced dead at the scene.

DaSilva and Dias were trapped inside the vehicle, while Dias' brother, Luiz, 27, was found outside the vehicle. DaSilva suffered serious injuries and was treated at Rhode Island Hospital in Providence; Luiz Dias was treated at Morton Hospital in Taunton, according to state police.

The other driver, Patrick Brandao, 21, of Brockton, was cited for driving recklessly to endanger, failing to drive within marked lanes and speeding, state police said.

Brandao, who was driving an Infiniti G35, and his passengers, Fernandes Wilson, 20, and Jonathan Alvez, 25, both of Brockton, were all treated at Good Samaritan Hospital in Brockton.

DaSilva was indicted Friday by a Bristol County Grand Jury and is expected to be arraigned later this month, said Gregg Miliote, a spokesman for Bistol County District Attorney Sam Sutter.

Brandao will be summonsed to Taunton District Court.

Witnesses told police that the two cars were following another car, a BMW, and that all were traveling faster than 100 mph.

None of the vehicles collided with each other. The two that went into the woods lost control almost simultaneously, according to state police.

The BMW stopped about 100 yards after the crash, but left the scene, state police said.

The owner of the BMW has been identified, but investigators have not determined who was behind the wheel at the time of the crash, state police said.

In a separate ongoing investigation, police confiscated a .40-caliber handgun found under the hood of the Infiniti by tow company workers. The handgun was taken to a state police lab for examination.
