Man gets 7-plus years for 5th OUI offense




Driver arrested after almost hitting cruiser
ATTLEBORO - A man with a history of drunken driving who nearly struck a police cruiser on Pleasant Street in December 2007 has been sentenced to 7 1/2 years in prison.

Steven M. Lahey, 46, of 250 Mansfield Ave. in Norton, was convicted Tuesday by a 12-member New Bedford Superior Court jury of a fifth-offense drunken driving charge and driving with a suspended license because of a drunken driving conviction.

Judge E. Susan Garsh gave Lahey a 4- to 5-year prison term for the drunken driving charge, followed by a 2 1/2-year jail term for the suspended license charge, according to Gregg Miliote, a spokesman for Bristol County District Attorney Sam Sutter.

Lahey was caught with an open beer bottle between his legs when he was stopped on Pleasant Street in Attleboro after almost colliding head-on with a cruiser driven by Norton Patrolman Jeffrey Zaccardi at a bend west of Richardson Avenue, according to court records.

Zaccardi was returning to Norton from Sturdy Memorial Hospital at the time, and turning his cruiser around to stop Lahey's car. He radioed a Norton dispatcher to contact Attleboro police, and stopped Lahey's car on Pleasant Street near Lindsey Street moments before Attleboro Patrolman Richard Pierce Jr. arrived, according to court records.

After completing his incarceration, Lahey will be placed on five years' probation, Miliote said.

The case was prosecuted by Assistant District Attorney Gregory Tinsworth.

" More often than not, when you read an article about a drunk driving accident for some reason the drunkard lives and the victims die. This man with a 5th offence should be removed from sociaty. Bravo,bravo,bravo to attorney Tinsworth for his unrelenting performance and byconvincing a jury of twelve of how dangerous this man is. Mr. Tinsworth won a difficult trial, and therefore may have saved any of our lives. Keep it up Greg. "

" That's a weak sentence for 5th conviction!! WTF?!?! I was under the impression that if you get convicted your third time that you lose your license for life!! Driving with a suspended license should be a very strict fine and jail time!!

Although we need to reduce the amount of money that it costs tax payers to have these bums in jail. It shouldn't cost much more than 4-5,000 bux per year!! "

" I Agree with the punishment for the OUI, or 5th OUI. I don't agree with the 2 1/2 year punishment for driving with a suspended license. Seems a little much. It must be a punishment for the 4th offense. I thought after the 2nd or 3rd you lost your license for 10 years to life? "

" Too bad the previous judges couldn't have given him a lesser jail time (6mos-2yrs) for the previous offense. It would have given this fool a reality slap earlier, kept the public safer, and kept the taxpayer cost down compared to the 7 1/2 yrs we have to pay for now.
